Examining this Fight for Transgender Rights: A Compelling Documentary Unveils the Human Story

Transgender filmmaker Sam Feder's recent feature "Heightened Scrutiny" presents a moving dual perspective – simultaneously an personal portrait of a key trans advocate and a sharp examination of media reporting about trans existence.

Legal Battle at the Supreme Court

This documentary traces ACLU lawyer Chase Strangio as he gears up for oral arguments in the important Supreme Court case US v Skirmetti. This legal battle took place in late 2024, with the court ultimately ruling in favor of the state's position, essentially enabling restrictions on healthcare for trans minors to remain in effect across over twenty US territories.

We created Heightened Scrutiny in just 16 months, shared Feder during an interview. By contrast, my previous film Disclosure took me half a decade, so this was a real push. Our purpose was to stimulate discussion so people would know more about the case.

Personal Story Amid Political Battle

While Feder offers a thorough analysis of how mainstream publications have disseminated transphobic rhetoric, the film's greatest accomplishment may be its compelling depiction of Strangio. Typically a measured lawyer in media settings, Strangio displays his authenticity throughout the production.

That was a substantial challenge, to open up parts of my life to a camera lens that I had worked hard to keep confidential, shared Strangio. Feder said he wanted future generations to know that we fought, to see what was done in defense of these battles for our material survival.

Diverse Perspectives in the Movement

To support Strangio's account, Feder includes numerous trans activists, such as prominent individuals from media and the arts. This production also presents insights from cisgender supporters who examine how respected publications have added to harmful reporting of trans individuals.

The viewpoint of trans minors key to the legal case is shown through a extraordinary 12-year-old student named Mila. Viewers initially witness her advocating for her peers at a school board meeting, with later scenes showing her demonstrating for trans rights outside the Supreme Court.

Personal Scenes Beyond the Legal Battle

Heightened Scrutiny also features touching moments where Feder moves beyond the constant legal battle, including scenes of Strangio vacationing in Italy and getting a tattoo featuring words from civil rights leader Pauli Murray's poem "Prediction."

This ink sequence is one of my preferred parts in the movie, stated Strangio. Being tattooed is practically like a meditative experience for me, to be completely aware in my body and to think of it as a vessel for things that are important to me.

Physical Autonomy and Portrayal

Feder's attention to lovingly capturing Strangio getting to his tattoo collection emphasizes that this documentary is fundamentally about transgender physical selves – not only those of youth who confront restriction of their ability to live authentically in their own bodies, but also the physical forms of the various subjects who appear in the production.

I create films with a message, and part of that is picking people who are brilliant and concise enough to sustain the camera, stated Feder. Whenever people ask me what they should wear for an interview, my response is anything that makes you feel confident. That is important to me – as transgender individuals, we struggle so much with our self-perception.

Impact and Optimism

A key element that causes Feder's works stand out is his clear talent for making his transgender interviewees feel respected, acknowledged and admired. This approach develops genuine connection between Feder and Strangio, helping the director to achieve his goal of presenting Strangio as a whole human being and providing a record for posterity of how determinedly he and fellow activists have struggled for transgender liberties.

I hope not people to find themselves in a state of incessant despair because of what the law is denying us, stated Strangio. I strive to be in a practice of using the law to reduce harm, but not to transform it into some sort of conduit for our freedom aspirations. Official institutions is not going to be the mirror through which we perceive ourselves. Our community are that mirror, and it's extremely important that we keep having that dialogue in addition to dialogues about fighting back these laws and approaches.
